LOCAL SUPERMAN — Terms and Conditions

Governing Law & Jurisdiction: Hyderabad, Telangana, India


1. Introduction

The Platform is intended primarily for users aged 18 years or older. Minors may access the Platform only under the explicit consent or supervision of a parent or legal guardian. By using the Platform, you acknowledge and accept these Terms, including all future revisions.


2. Nature of Service

Local Superman (“LS”) is strictly a listing and discovery platform. LS facilitates the discovery of independent Professionals but does not mediate, endorse, guarantee, participate in, or control any transaction, service, or interaction. Users are solely responsible for verifying the qualifications, licenses, and suitability of any Professional listed on the Platform.


3. Professional Standards & User Responsibility

LS conducts manual presence verification of Professionals where applicable; however, LS makes no representations or warranties regarding the legality, quality, skills, or regulatory compliance of any Professional. Users must independently verify any professional’s qualifications, credentials, licenses, and suitability. Any engagement with Professionals is at the user's own risk.


4. Prohibited Categories
  • Escort/sexually explicit services
  • Unlawful gambling or betting
  • Narcotics or prohibited substances
  • Forgery/false documents or credentials
  • Incitement to violence/hate/crime
  • Political campaigning, paid propaganda
  • Any unlawful activity as per Indian law

(Astrology, Vastu, or religious services may be listed if lawful and compliant.)


5. Content Ownership & SEO License

Professionals retain intellectual property rights in their content. By submitting content, you grant LS a non-exclusive, royalty-free, worldwide license to host, adapt, optimize, publicly display, and use content for operating, SEO, and marketing purposes until a written removal request is received.


6. Payments, Renewals & Refunds
  • Professional profiles are visible only during an active, paid subscription period.
  • Renewals involve manual verification and payment; notifications may be sent digitally or via calls.
  • All payments are strictly non-refundable except for duplicate billing errors. Subscriptions are final once paid.

7. Indemnity

Professionals agree to indemnify and hold harmless LS, its directors, officers, employees, and agents from any claim, damage, or liability arising from professional services, violation of law, or breach of these Terms.


8. Moderation & Reports

LS may act on reports from Users regarding Professionals at its sole discretion. LS reserves the right to suspend or terminate profiles immediately in cases of serious violations. Affected parties will be notified when feasible. LS is not responsible for investigation outcomes, errors, or delays.


9. Limitation of Liability

LS provides the Platform “as-is” and makes no warranties regarding accuracy, legality, or suitability of Professionals or content. LS shall have no liability whatsoever beyond the subscription fee paid and makes no guarantees regarding operational, financial, or reputational outcomes. Users assume all risk when using the Platform. This limitation does not affect statutory consumer rights for fraud or wilful misconduct.


10. Dispute Resolution & Arbitration

These Terms are governed by Indian law, with Hyderabad courts having exclusive jurisdiction. At the election of either party, disputes may be referred to binding arbitration under the Arbitration & Conciliation Act, 1996, conducted in Hyderabad in English before a sole, mutually appointed arbitrator. LS does not intervene in disputes between Users and Professionals.


11. Platform Availability & Termination

LS may suspend or terminate listings or access for violations, fraud, abuse, or conduct harmful to the Platform or its community, at its sole discretion and without notice. Planned maintenance, technical issues, or force majeure may cause temporary outages.


12. Cybersecurity & Data Breach Disclaimer

Local Superman implements reasonable security measures including HTTPS, encrypted password hashing, encrypted data transmission, and technical controls such as rate limiting, account lockout, and input validation. While we strive to protect all data, no system is entirely secure, and we cannot guarantee the prevention of unauthorized access, breaches, or data loss. In the event of a data breach, Local Superman will promptly take steps to mitigate the impact, notify affected individuals, and comply with applicable laws, including timely reporting to the Indian Computer Emergency Response Team (CERT-In).


13. Updates to Terms

Local Superman will update these Terms from time to time to reflect changes in operations, legal requirements, or Platform features. Users are expected to review the Terms periodically. Continued use of the Platform after such updates constitutes acknowledgment and acceptance of the revised Terms.


Acknowledgment: By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, including all updates and revisions.

Privacy Policy

LOCAL SUPERMAN — Privacy Policy

Entity: VSS Gowri Tech Online Pvt Ltd ("Local Superman")


1. Information We Collect
  • Professionals: Name, DOB, phone, email, address, PIN code, geolocation (if consented), business/social links, and encrypted password.
  • Users: No accounts required. Optional contact/report fields (name, phone, email, message) may be processed to forward to the chosen Professional.
  • IP logs: Collected for Professionals at signup and when Users submit feedback/report, for anti-abuse and compliance.

2. How We Use Data
  • Create and display listings; process subscriptions, renewals, and support requests.
  • Security purposes (IP analysis, abuse/fraud prevention).
  • Improve search relevance (including SEO description generation).
  • Legal, regulatory, and compliance requirements.

3. Sharing

Data is shared only with service providers under contract and confidentiality. Disclosure may occur if required by law or court order. No sale or rental of personal data.


4. Retention & Deletion
  • Professional profiles visible only during active subscription.
  • On expiry/deletion, profiles are unpublished but securely archived for compliance (without passwords).
  • Billing/payment data retained for 8 years.
  • IP logs retained for max 12 months, then deleted/anonymized.

5. Security & Breach

Local Superman implements reasonable technical and organizational security measures designed to protect user data from unauthorized access, alteration, disclosure, or destruction. In the event of a data breach or security incident, Local Superman will promptly take steps to contain and mitigate the breach, notify affected parties as required by applicable law, and comply fully with all legal and regulatory obligations including reporting to relevant authorities.


6. Your Rights
  • Access, correct, or delete Professional profile data.
  • Data portability in machine-readable format upon request.
  • Withdraw consent for optional features (e.g., analytics or marketing).

7. Cross-Border Data Processing

Cloud infrastructure (e.g., AWS, MongoDB) may process data outside India. LS ensures compliance with DPDP Act 2023 and implements appropriate safeguards.


8. Children's Privacy

Platform is intended for users 18+. LS does not knowingly collect personal data from minors. Any minor using the Platform must do so under explicit parental/guardian supervision, and all risks are borne by the guardian.


9. Updates to Privacy Policy

Local Superman will update this Privacy Policy from time to time to reflect changes in operations, legal requirements, or Platform features. Users are expected to review the Policy periodically. Continued use of the Platform after such updates constitutes acknowledgment and acceptance of the revised Privacy Policy.

1. Community Guidelines
  • All Professionals undergo manual verification prior to listing.
  • Strict adherence to ethical and lawful conduct is required.
  • User–Professional interactions are independent; LS is not a party or intermediary.
  • Prohibition of illegal or unauthorized categories as detailed in Terms & Conditions.

2. Regulatory Compliance

LS complies with all relevant Indian laws, including DPDP Act 2023, IT Rules 2021, Consumer Protection [E-Commerce] Rules 2020, Indian Contract Act 1872, GST requirements, MCA/ROC filings, and other applicable statutes. Professionals are responsible for industry-specific regulations; LS may request verification. Users and Professionals acknowledge that compliance verification is their own responsibility.


3. Cybersecurity & CERT-In Reporting

Local Superman implements reasonable security measures including HTTPS, bcrypt password hashing, rate limiting, and account lockout to protect user data. While we strive to safeguard information, no system is completely secure and unauthorized access or breaches may occur. Local Superman is committed to promptly responding to any data breaches and will take all reasonable steps to notify affected parties and report notifiable cybersecurity incidents to CERT-In within legally required timelines. Users and Professionals acknowledge these efforts but understand that absolute security cannot be guaranteed.


4. Accessibility Commitment

LS strives to provide accessible services under the Rights of Persons with Disabilities Act, 2016, and will make reasonable accommodations upon request, subject to technical feasibility.

6. Liability & Force Majeure

LS operates solely as a listing platform and is not liable for service quality, outcomes, or any damages. LS disclaims responsibility for all indirect, consequential, or special damages, and is not liable for disruptions due to natural disasters, government actions, or other force majeure events. Users and Professionals acknowledge and accept full responsibility for verifying Professionals themselves and engaging at their own risk.


7. Governing Law & Acceptance

This Framework is governed by the laws of India, with exclusive jurisdiction vested in Hyderabad courts, Telangana. By using the Platform, Users and Professionals explicitly acknowledge that they have read, understood, and accepted this Legal & Compliance Framework in its entirety, including any future updates.

Version Control & Acknowledgment

This document is maintained under a version control system. Each version is identified by a unique version number and an effective date. Users and Professionals are bound by the version in effect at the time of their onboarding or acceptance of updates. The Company may issue updated versions from time to time. Continued use of the Platform after publication of a new version constitutes explicit acknowledgment and acceptance of such updates.
